Terms of Service

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", "our"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers, these Terms also include the Listing Agreement, incorporated by reference. Where the Listing Agreement conflicts with these Terms on listing specifics, the Listing Agreement prevails.

These Terms apply to all HALP platforms including www.halp.com.au, www.boutiquedevelopments.com.au and associated apps and websites in our network.

By accessing or using our services you acknowledge you have read and understood these Terms; agree to be bound by them and our Privacy Policy; represent you are at least 18; and have the authority to enter this agreement. If you do not agree, cease using our services.

We may modify these Terms at any time. We will update the "Last Updated" date, notify registered users by email, and prominently display material changes. Continued use after posting constitutes acceptance.

2. Description of Services

HALP operates specialised property discovery and business directory platforms — house and land listings, off-the-plan project information, boutique showcases, school zone integration, property calculators, mortgage broker connections, market insights and educational content. We also provide a professional business directory (freemium), lead generation and inquiry management, business profile management and CRM integration.

Nature of service. HALP is an information and advertising platform. We are not a real estate agent, developer, builder or financial advisor. We facilitate connections but do not act as your agent, do not provide property/financial/legal/tax advice, and do not guarantee the accuracy of third-party listings.

Lead routing. Property listing inquiries go directly to the listing agent/developer/builder — HALP does not store, read or process those inquiries. Contact Us / Join Us / Advertise With Us inquiries are stored in our CRM systems (Pipedrive, ActiveCampaign) with supporting docs in Google Drive.

Service availability. Services are provided "as is" and "as available". We may modify, suspend or discontinue services at any time. Infrastructure includes AWS, Synergywholesale (domain hosting), Google Workspace, Stripe, Pipedrive, ActiveCampaign and Zapier. Providers may change over time.

3. User Accounts and Registration

You may need to create an account to access certain features. You must provide accurate information, be at least 18, keep your credentials secure, and only create one account per person. Business accounts require a valid ABN/ACN. You are responsible for all activity under your account. Contact support@halp.com.au to terminate. We may suspend/terminate for breach, false information, fraudulent activity, non-payment or extended inactivity.

4. User Conduct and Prohibited Activities

You must comply with all laws, use services for lawful purposes only, provide truthful information, respect IP, and act in good faith. You must not misuse the platform (bots/scrapers, interfering with functionality, unauthorised access, reverse engineering), post harmful content (false, misleading, spam, phishing, viruses, impersonation), engage in illegal activities, harass or abuse others, or misuse commercially (reselling, competing, scraping, multiple accounts). Violations may result in suspension, content removal, legal action or law-enforcement reporting.

5. Property Listings and Information

Property listings are provided and owned by developers, builders, agents and third-party providers. HALP does not own/control listings, does not verify all information, does not endorse any property, and does not guarantee availability or pricing. Property information may change without notice — always verify critical details directly. We disclaim warranties on listings.

School zone data is sourced from government databases and third parties, provided for reference only, subject to change, and not guaranteed. Always verify catchment zones directly with the education department and the individual school before making property decisions.

6. Business Directory Listings

Advertisers must hold a valid ABN/ACN, be a legitimate operating business, comply with all applicable laws, provide accurate information and hold necessary professional licences. Listings must accurately describe services, include current contact info, use your own brand, comply with Australian Consumer Law and not be misleading. Prohibited: illegal promotions, unsubstantiated claims, code-of-conduct violations, bait advertising, discrimination, IP infringement.

Free listings are basic and subject to availability. Premium subscriptions require monthly/annual payment, auto-renew unless cancelled, and are subject to their subscription agreement. You must respond to inquiries promptly, comply with privacy laws, honour representations in your listing and not spam.

7. Payment Terms (Advertiser Subscriptions)

Pricing is as displayed on our website, at checkout or in the applicable Listing Agreement. All fees in AUD; prices exclusive of GST unless stated (GST added at checkout where applicable). Standard payment-processing fees are included unless we state otherwise. Payments are processed via Stripe (PCI-DSS Level 1); we do not store complete card numbers.

Subscriptions auto-renew unless cancelled before the next billing date. No partial refunds for unused time in the current period. No refunds for voluntary cancellations. Pro-rata refunds for technical issues preventing access. Refunds processed within 14 business days. Non-payment may result in service suspension after 7 days and listing removal after 14 days; unpaid fees remain due.

8. Intellectual Property Rights

All content on our platforms is owned by HALP or licensed to us — including logos and trademarks ("HALP", "House And Land Packages", "Boutique Developments"), website design, software, text, graphics, images, data compilations and school zone data aggregations. We grant you a limited, non-exclusive, revocable licence to access our platforms for personal, non-commercial use. You retain ownership of user-generated content but grant us a worldwide, royalty-free licence to use it. For copyright infringement contact legal@halp.com.au.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, investment, legal, tax or real-estate advice. Calculators provide estimates only. We facilitate connections but do not control third-party conduct or guarantee their services. Information may contain errors; property data may be outdated. We do not guarantee continuous availability, error-free operation or absence of viruses. Our platform relies on third parties (AWS, Stripe, etc.) — we are not responsible for their failures.

10. Limitation of Liability

To the maximum extent permitted by law, HALP and its officers are not liable for direct damages (lost profits, data, business opportunities) or indirect damages (consequential, incidental, special, punitive) arising from your use of our services, third-party conduct, unauthorised account access, service interruptions or property transactions. Where liability cannot be excluded, it is capped at $100 AUD for free services, and for paid services the lesser of $1,000 AUD or the amount you paid in the prior 12 months. Nothing excludes rights under the Australian Consumer Law. You indemnify HALP against claims arising from your breach of Terms, violation of law/rights, use of services or interactions with third parties.

11. Dispute Resolution

Before initiating proceedings, contact legal@halp.com.au and allow 30 days for informal resolution. Governed by the laws of New South Wales, Australia (exclusive jurisdiction NSW courts). Optional arbitration under ADRA rules in Sydney. Class actions waived to the extent permitted. Injunctive/equitable relief remains available for IP, confidentiality, prohibited activities or irreparable harm.

12. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement. If any provision is invalid or unenforceable, it is limited or eliminated to the minimum extent necessary; remaining provisions continue in full force. No waiver by non-enforcement. You may not assign without our consent; we may assign to an affiliate or in connection with a sale. Notices to you via email/website/in-app; legal notices to us at 235 Glen Huntly Road, Elsternwick VIC 3185 or legal@halp.com.au. English prevails in case of translation conflict.

13. Special Terms for Specific Services

Mortgage calculators provide estimates only, not pre-approvals, and should not replace professional advice. School zone data is aggregated from public databases, provided "as is", subject to change and enrolment is not guaranteed by living in a catchment. Property alerts consent to email/SMS notifications, modifiable any time. Home loan referrals may generate a referral fee or commission; brokers are independent, licensed third parties; loan approval is not guaranteed.

Platform — all HALP websites, apps and related services. User — any person/entity using our services. Content — all information on our platforms. Property Provider — developers, builders, agents, listers. Advertiser — professionals/businesses in our directory. Personal Information — as in the Privacy Act 1988. Listing — any property/business/content posted on our platforms.
